Mental Health Discrimination

Karen acted for the widow of a man who took his own life after being summarily dismissed following a disciplinary procedure during the course of which his employer knew that he was suffering serious mental health issues. Proceedings were issued in the Employment Tribunals for disability discrimination. Parallel proceedings were intimated under the Fatal Accidents Act 1976 because a financial claim beyond death is limited in the Employment Tribunal. The case settled successfully out of court.
