We act for all kinds of clients with a variety of disabilities. Those listed on this page are a sample of matters we have dealt with but do not nearly capture all the work we have done over the years and continue to do. Some clients have multiple disabilities.

Remember that being diagnosed with a disability by a medical professional or having a disabled person’s Blue Badge is not the same as being considered as disabled in the law. The test is completely different. You could have a long-term health condition that is not a disability in law. Only a judge can determine definitively if you are disabled according to the Equality Act section 6 definition of disability.

The test has four parts which must be met:

  1. Do you have a physical or mental impairment (1)? (You might have both).
  2. Does it have a substantial (2) long-term (3) adverse effect on your normal day to day activities (4)? (This requires proving that the impairment is substantial and long-term and that it impacts your daily life).

Schedule 1 makes further provisions about disability including specifying which are the so-called automatic disabilities. These are HIV, MS and cancer. This also applies to some severe sight impairments. The Equality Act 2010 makes provision for excluded conditions which cannot be disabilities. This includes exhibitionism, severe tattooing, drug or alcohol addiction. Remember though that if your addiction is related to or caused by another impairment that impairment might still mean that you are disabled. A classic example is someone who is an alcoholic because they suffer from severe depression and anxiety.
