Disability Discrimination At Work

10 April 2024

Karen acted for a young man with early onset Parkinson’s who was under threat of performance management, disciplinary proceedings and dismissal. He had not disclosed to his employer the nature of his health issues so was being judged on the fact that he did not present well in presentations and similar. The issues with his work were directly related to his disability. We advised him to take sickness absence, which was paid, while he worked with medics to get his symptoms under control. We also advised him to inform his employer about his disability and to ask whether the benefit of Group Income Protection was available to him. Luckily it was.

Our client successfully applied for GIP and was accepted. He has secured an income for his family for life on the basis that he is incapacitated from ever working again.
